NOTICE INVITING BIDS (NIB) FOR LANDSCAPE MAINTENANCE SERVICES

NOTICE IS HEREBY GIVEN that sealed bids will be received by the City of Rancho Santa Margarita (City) for furnishing all materials, equipment, tools, labor and incidentals as required for the above stated maintenance services in accordance with the requirements set forth in the NIB, including the Scope of Services, sample draft landscape maintenance services agreement, and all attachments and appendices.  To be considered responsive, qualified Proposers must submit a written proposal in accordance with the requirements, specifications, conditions, and provisions as described and set forth herein.

Bids will be received at the office of the City Clerk, City of Rancho Santa Margarita, until 2:00 p.m. on Thursday, October 10, 2019, at which time and place the bids will be publicly opened.  Bids shall be submitted in sealed envelopes marked on the outside, “SEALED BID FOR LANDSCAPE MAINTENANCE SERVICES- DO NOT OPEN WITH REGULAR MAIL.”

PRE-BID MEETING – Any bidder intending to submit a Bid Proposal for this Project is encouraged to attend a Pre-bid Meeting to be held on October 2, 2019, promptly beginning at 11:00 a.m. The meeting shall be held at Rancho Santa Margarita City Hall 22112 El Paseo, Rancho Santa Margarita, CA 92688.

The work to be performed hereunder is located in the City of Rancho Santa Margarita and generally includes landscape maintenance of City owned facilities. The four (4) City owned facility locations are the City Hall/BTRCC Facility, Alicia T Monument, medians on Plano Trabuco Road, and the City’s Dog Park Facility as described in the NIB.

The City reserves the right, after opening bids, to reject any or all bids and will procure the services for Project consistent with the City’s procurement regulations, procedures, and best qualified vendor criteria set forth in Section 3.07.060 and 3.07.111 of the Rancho Santa Margarita Municipal Code (RSMMC), respectively, as determined solely by the City; to waive any informality in the bidding, to accept any bid or portion thereof; and to take all bids under advisement for a period of ninety (90) days. Bids will be compared on the basis of the Engineer’s estimate of the quantities of the several items of work as shown on the bid sheets. A full and complete copy of Sections 3.07.060 and 3.07.111 of the RSMMC is provided within the Instruction for Bidders section of the NIB. To facilitate the City’s determination of the Best Qualified Vendor, Bidder shall provide up to ten pages of additional information about their unique qualifications meeting the City’s needs for this Project as part of the submission of their Bid Proposal. The City may, at its discretion, after the opening of the Bids, schedule interviews of the lowest responsive, responsible Bidders as part of its determination of the Best Qualified Vendor. Bidders shall be notified of a schedule of interviews and shall participate upon an invitation issued by the City.

At the time of contract award, the Contractor shall have and maintain a State of California Contractor’s License as appropriate for the work for the duration of these services. There is no City Business License requirement.  The City requires either the State Compensation Insurance Fund or a carrier rated B+ or above for Workers’ Compensation Insurance.

The selected company/Contractor shall enter into the City’s Landscape Maintenance Services Agreement, which includes the following provision regarding Prevailing Wages: “The City has determined that the Work and Services under this Agreement requires work of labor categories which are subject to Prevailing Wage Laws identified in the State of California Labor Code. Contractor is aware of the requirements of California Labor Code Section 1720, et seq., and 1770, et seq., as well as California Code of Regulations, Title 8, Section 16000, et seq., (“Prevailing Wage Laws”), which require the payment of prevailing wage rates and the performance of other requirements on “public works” and “maintenance” projects.  Contractor agrees to fully comply with all applicable federal and state labor laws (including, without limitation, if applicable, the Prevailing Wage Laws). It is agreed by the Parties that, in connection with the Work or Services provided pursuant to this Agreement, Contractor shall bear all risks of payment or non-payment of prevailing wages under California law, and Contractor hereby agrees to defend, indemnify, and hold the City, its elected officials, officers, employees, and agents free and harmless from any claim or liability arising out of any failure or alleged failure to comply with the Prevailing Wage Laws. The foregoing indemnity shall survive termination of this Agreement.”

Except for any work or services that are considered to be cleaning, custodial, and janitorial in nature, the City has determined that the work or services contemplated herein are Public Works as defined in the State of California Labor Code, therefore such work or services shall be subject to compliance monitoring and enforcement by the Department of Industrial Relations (DIR). The prevailing wages applicable to this procurement are available on the DIR web page at www.dir.ca.gov. It is the Bidder’s sole responsibility to incorporate the cost of complying with all prevailing wage and labor compliance requirements and all applicable laws for this Project. The successful Bidder and its subcontractors of any tier, if any, shall maintain active registration with DIR, as appropriate, for the duration of this Project. Additional Prevailing Wage requirements are set forth in more detail as terms and conditions in the attached (see Appendix 3) “Sample Draft Landscape Maintenance Services Agreement – Subject to Revision by City Upon Final Contract Award” to the NIB.
